1. Who you are contracting with

PivotYourIdea is operated by Atris Bekteshi ("PivotYourIdea", "we", "us", "our"), trading as PivotYourIdea. By creating an account or using the service, you enter into a binding agreement with Atris Bekteshi.

2. Acceptance of terms

By continuing to access or use the service, you agree to these Terms & Conditions. If you do not agree, do not use the service. If you accept on behalf of an organisation, you confirm you have authority to bind that organisation. If you are an individual, you confirm you are of legal age in your jurisdiction.

3. The service

PivotYourIdea is an AI-powered startup-validation tool that generates analysis, critiques and related outputs ("Outputs") from inputs you submit. Outputs are AI-generated, may be inaccurate or incomplete, and must not be relied on as legal, financial, investment, medical or other professional advice. You are solely responsible for any decision made on the basis of Outputs.

4. Your account

You must provide accurate, current information at sign-up and keep it up to date. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us promptly of any unauthorised use.

5. Payments, subscriptions and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, taxes, currency, invoicing, cancellation and refund mechanics for purchases (including credit packs and any subscription plans) are governed by Paddle's Checkout / Buyer Terms and Paddle's Refund Policy, in addition to our own Refund Policy. Any subscription auto-renews at the end of each billing period until cancelled; you can cancel at any time from the in-app billing portal or via paddle.net, and access continues until the end of the period already paid for. Prices may change with prior notice and will apply at the next renewal.

6. Acceptable use

You agree not to misuse the service. In particular, you must not:

• use the service unlawfully, fraudulently, or to send spam;
• infringe the intellectual-property or privacy rights of others;
• upload malware or attempt to probe, scan, or compromise security;
• scrape, mirror, or otherwise extract the service in bulk;
• reverse engineer, decompile, or attempt to derive source code, except where law permits;
• resell, sublicense or redistribute the service without our written permission;
• circumvent rate limits, credit allowances, or other technical restrictions.

7. AI-specific terms

• You are responsible for your prompts and for how you use Outputs, including verifying accuracy and having the necessary rights to any input content you submit.
• Do not use the service to generate illegal content, hate speech, harassment, malware, deepfakes, or to attempt to jailbreak the underlying models.
• Outputs may be inaccurate and are not a substitute for qualified professional advice. Do not rely on Outputs for regulated decisions without independent oversight.
• We may filter, restrict or refuse Outputs, and may remove content or suspend accounts for policy violations.
• Rights-holders may submit takedown requests to legal@pivotyouridea.com; repeat infringers will be terminated.

8. Intellectual property

We retain all rights, title and interest in and to the service, including software, models, branding and documentation. Subject to these terms, we grant you a limited, non-exclusive, non-transferable right to use the service for your internal business or personal use. You retain ownership of content you submit and, subject to the underlying model providers' terms, of Outputs generated for you. You grant us a limited licence to host and process your content solely to operate and improve the service.

9. Service level

We work hard to keep the service available, but we do not guarantee uninterrupted or error-free performance. The service is provided on an "as is" and "as available" basis.

10. Suspension and termination

We may suspend or terminate access for: material breach of these terms, non-payment, security/fraud risk, abuse of the AI service, or repeated or serious policy violations. You may terminate at any time by deleting your account. Upon termination, your right to use the service ends; we will retain or delete your data in line with the Privacy Notice.

11. Warranties and liability

To the maximum extent permitted by law, we disclaim all implied warranties (including merchantability and fitness for a particular purpose). Our aggregate liability arising out of or in connection with the service is limited to the fees you paid in the 12 months preceding the event giving rise to the claim. We exclude liability for indirect, incidental, special or consequential damages, including loss of profits, data, or goodwill. Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be limited under applicable law.

12. Indemnity

You will indemnify and hold us harmless from claims arising from your content, your use of Outputs, or your breach of these terms.

13. Governing law

These terms are governed by the laws of the seller's place of establishment. Disputes will be submitted to the competent courts of that jurisdiction, without prejudice to any mandatory consumer-protection rights you may have where you live.

14. Changes

We may update these terms from time to time. Material changes will be notified in-app or by email. Continued use after the effective date constitutes acceptance.
